Just-In: Court Declares Pat Utomi’s Shadow Cabinet Illegal

A Federal High Court in Abuja has issued an injunction barring Professor Pat Utomi and his associates from advancing their initiative to form a shadow government or cabinet in Nigeria, declaring it “unconstitutional.”

The ruling, delivered on Monday by Justice James Omotosho in response to a suit filed by the Department of State Services (DSS), said the concept of a shadow government is incompatible with Nigeria’s presidential system and therefore unconstitutional.

Justice Omotosho emphasised that while citizens have the right to associate and express dissent, such freedoms cannot be used as a cover for unlawful conduct.

He lauded the DSS for initiating the legal action and affirmed that the agency was within its mandate to act against activities that pose a threat to national security.
